1. Acceptance of Terms

These Terms of Service (“Terms”) form a legally binding agreement between you (“User,” “Client,” “you,” or “your”) and Launch Dream LLC, operating as New Second Homes (“Company,” “we,” “us,” or “our”).

By accessing or using our websites, blogs, podcasts, newsletters, or services (collectively, the “Services”), you agree to these Terms and to our Privacy Policy.
If you do not agree, do not use the Services.


2. Eligibility

You must be at least 21 years old (or the age of majority in your jurisdiction) to use the Services.

By using the Services, you represent that you meet this requirement.


3. Description of Services

3.1 Services Provided

New Second Homes offers educational information and referral services related to international real-estate communities, including:

  • Market information and general guidance on international property considerations

  • Newsletters, educational podcasts and webinars, and other informational content

  • Introductions to international developers and professional service providers

  • Referrals to attorneys, tax advisors, immigration experts, and relocation specialists

  • Facilitation of discovery trips and community visits

3.2 Services NOT Provided

We do not:

  • Act as licensed real-estate brokers, agents, or transaction facilitators

  • Provide legal, tax, or investment advice

  • Offer financial planning or guarantee returns

  • Handle real-estate transactions, closings, escrow, or property management

  • Conduct property inspections or due-diligence investigations

  • Provide immigration or visa consulting

  • Serve as fiduciaries for any party

3.3 Referral Compensation Disclosure

We receive referral compensation from developers or service providers when referred clients complete transactions or engage services.

Typical compensation is up to 5 % of the property purchase price for real-estate referrals and varies for other products or services referrals.

This financial relationship may influence the communities or services we feature or recommend.


4. International Risks and Disclaimers

International property ownership involves significant risks, including but not limited to: political instability, currency fluctuations, regulatory changes, natural disasters, economic instability, limited legal recourse, infrastructure issues, and healthcare limitations.

We make NO guarantees about property values, property quality, market performance, developer completion, rental income, government approvals, currency exchange rates, or immigration/visa outcomes.

All information is for general educational purposes only, may change without notice, and is not guaranteed to be current or error-free.


5. User Responsibilities

You are solely responsible for:

  • Obtaining professional advice from qualified international real-estate attorneys, tax professionals, financial advisors, and immigration specialists

  • Conducting independent property inspections and verifying developer credentials

  • Understanding all legal, tax, immigration, and market implications of any purchase

  • Securing appropriate insurance and complying with all applicable laws


6. Regulatory and Third-Party Matters

6.1 No Fiduciary Relationship

Our relationship is strictly contractual; we owe no fiduciary duties.

6.2 Third-Party Services

We may recommend third-party product or service providers but make no warranties about their qualifications, services, or results.

Any relationship with such providers is solely between you and them.

6.3 U.S. & International Compliance

We comply with applicable U.S. laws, including anti-money-laundering regulations (Bank Secrecy Act), the Foreign Corrupt Practices Act, Export Administration, Regulations, OFAC sanctions, and tax-reporting requirements (FBAR, FATCA).
International operations remain subject to local laws, foreign-investment restrictions, tax obligations, and data-privacy regulations.

You are responsible for compliance with all applicable U.S. and foreign laws, tax reporting, currency reporting, immigration/visa requirements, and anti-money-laundering rules.


7. Privacy and Data Protection

  • Privacy Policy: Your use of the Services is governed by the separate Privacy Policy.

  • International Data Transfers: By using the Services, you consent to the processing and storage of data in the United States and its transfer to international service providers.

  • Data Security: We use reasonable safeguards but cannot guarantee absolute security of information transmitted or stored electronically.


8. Intellectual Property

All content, trademarks, logos, service marks, text, graphics, images, videos, and other materials provided by us (”Company Content”) are owned by or licensed to Launch Dream LLC. You receive a limited, non-exclusive, non-transferable license to access and use Company Content solely for personal, noncommercial purposes. You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit Company Content without our prior written consent.

AI and Machine Learning Restrictions: You may not use Company Content to train, develop, or improve artificial intelligence models, machine learning algorithms, or automated systems without our express written permission. This prohibition includes but is not limited to scraping, mining, or systematically extracting Company Content for use in AI training datasets, chatbots, or similar technologies. Authorized use of AI assistants to interact with Company Content for personal reference purposes does not constitute a violation of this restriction.


9. User Content

If you submit or upload materials (e.g., reviews, comments, images, audio, videos) to the Services (“User Content”), you grant us a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, adapt, publish, translate, and display such User Content in any media.

You represent that you have the necessary rights to grant this license and that your User Content does not infringe any third-party rights or violate any law.
We may remove or edit User Content at our sole discretion.


10. Fees, Payments, and Refunds

If any Services require payment, you agree to provide accurate billing information and authorize us to charge the stated fees.

All fees are non-refundable unless expressly stated in a separate written agreement.
You are responsible for any applicable taxes.


11. Electronic Communications & E-Signatures

By using the Services, you consent to receive newsletters, notices and other communications electronically.

Electronic signatures and records carry the same legal effect as written signatures and paper documents.


12. Limitation of Liability

To the maximum extent permitted by law, our total liability for claims arising from these Terms or the Services will not exceed the total fees you paid to us in the twelve (12) months preceding the claim.

We are not liable for indirect, incidental, consequential, special, or punitive damages, or for losses related to currency fluctuations, political changes, developer defaults, or immigration/visa denials.


13. Indemnification

You agree to indemnify, defend, and hold harmless Launch Dream LLC, New Second Homes, and our officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorney fees) arising from:

  • Your use of the Services

  • Your violation of these Terms or applicable laws

  • Property purchases or investment activities, including international transactions

  • Any misrepresentation of information provided to us

  • Immigration, tax, currency, or regulatory issues


14. Dispute Resolution

  • Governing Law: These Terms are governed by the laws of Virginia, USA, without regard to conflict-of-law principles.

  • Process:

    1. Good-faith negotiation for 30 days

    2. Binding mediation in Fairfax County, Virginia

    3. If unresolved, individual arbitration under the American Arbitration Association (AAA) Commercial Rules, also in Fairfax County, Virginia

  • Class Action Waiver: You waive any right to participate in class-action lawsuits or class-wide arbitrations.


15. Termination

Either party may terminate Services with thirty (30) days’ written notice.
Upon termination:

  • All unpaid fees become immediately due.

  • Confidentiality obligations survive.

  • No refunds are provided for Services already rendered.


16. General Provisions

  • Force Majeure: Neither party is liable for delays or failures due to circumstances beyond reasonable control, including natural disasters, government actions, war, terrorism, pandemics, or scheduled maintenance.

  • Entire Agreement: These Terms constitute the entire agreement and supersede all prior understandings.

  • Amendment: We may update these Terms at any time. Continued use constitutes acceptance.

  • Severability: If any provision is held invalid, the remaining provisions remain enforceable.
